The Application & The Agreement shall begin on 01st April 2023 and shall end on 31st March 2024, unless terminated earlier as provided herein.

Either party (member / club) may terminate this Agreement upon 15 Days written notice to the other party (member / club) in the event of a material breach by the other party of any of the terms or conditions of the application & agreement.

The applying member shall indemnify and hold harmless the Club, its officers, directors, employees, agents, and representatives, from and against any and all claims, damages, liabilities, costs, and expenses, including reasonable attorney's fees, arising out of or in connection with the Member’s performance under the application & agreement.

By submitting the membership request, the applicant hereby agree to participate in the activities offered by the Club (the "Club") and acknowledge that apllicant doing so voluntarily and at their own risk. The applicant understand that the Club cannot guarantee apllicant's safety, and the appliacnt assume full responsibility for any injuries, losses, or damages that the applicant may sustain while participating in the Club activities.

In consideration for the participation in the Club's activities, the applicant hereby release, waive, discharge, and covenant not to sue the Club, its officers, directors, employees, agents, and volunteers from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by the appliacnt, or to any property belonging to the appliacnt, while participating in the Club activities.

The applicant understand that this waiver and release includes any claims based on negligence, action, or inaction of the Club, its officers, directors, employees, agents, and volunteers, whether a COVID-19 related illness or injury, other infectious diseases or not, and that it extends to all claims of every kind and nature whatsoever, whether known or unknown, foreseen or unforeseen, future or contingent.

The applicant acknowledge that they have read this waiver and release, fully understand its terms, and understand that the applicant is giving up substantial rights, including the right to sue. The applicant acknowledge that he/she is agrees the waiver and release freely and voluntarily and that it is binding upon the applicant, their heirs, executors, administrators, and assigns.

This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without giving effect to its principles of conflicts of law.

This Agreement constitutes the entire understanding of the parties hereto and supersedes all prior and contemporaneous communications and agreements, whether oral or written. By submitting the registration, the parties have executed this Agreement as of the date first written above.
